INFORMATIVE NOTE regarding Law no. 196 dated 30.06.2003
Dear customer,
according to the Art. 13 from the Law no. 196 dated 30.06.2003 IN(Privacy Code) we wish to inform you that your personal data, including the email address that you will be using to contact info@funglassesonline.com or through one of the forms on our website, will be processed by Galvani S.r.l. in accordance with the above mentioned Legislation.
According to the Law 196/2003 regulations, data processing is carried out in respect of fairness, lawfulness, transparency and protection of your privacy and your rights. Galvani Srl wishes to inform you that:
User’s personal data provided during commercial relationships and/or promotional activities or contractual relationships will be processed:
a) for the following purposes: compliance with tax, accounting and legislative obligations; information exchange and commercial contacts (pre-contractual negotiations when the User wishes to avail of Galvani Srl offers); compliance with obligations resulting from contracts signed with customers; products and accessories supply, assistance, replacement, repair and after sale; management and administration of clients, orders, shipments, invoice issuing, solvency control;
b) for commercial activity purposes (marketing and advertising, promotional activities and information regarding future commercial initiatives, service innovation);
The data provided by the User can be transferred to tax advisors and banks for takings and payments management connected with the authorized contract execution.
The data provided by the User, can also be transferred (after an inspection or control) to the Authorities in charge of verifying the correct fulfillment of civil and fiscal obligations.
The provision of personal data as per point a) is mandatory for the purpose of Law obligations fulfillments and/or establishment and/or fulfillment of the contractual relationaship. In absence of provision of personal data as per point a) it will be impossible to establish and/or carry out the contractual relationship.
The provision of personal data as per point b) is optional and fuctional for providing a better customer service. There will be no consequences in case of refusal.
User’s personal data can be communicated to other companies for the same purposes listed above or to external subjects specialized in:
- software, hardware, telematic and information systems management;
- data processing and storage activities;
- activities related to printing, transmission, packaging, transport, sorting of goods for customers;
Data processing activities will be carried out both manually and electronically. Data can be stored both in paper and electronic archives, to allow aggregated data identification and selection, when needed. Data processing will be carried out directly by the owner organization, with the help of his appointees. It will be carried out following an approach that is strictly connected to the above mentioned purposes and following a method that guarantees data security and protection. It will be carried out making sure that any altering, cancelling, distruction, unauthorized access is avoid and to prevent data processing that is not compliant with the purposes stated above.
If the User wishes to purchase eyeglasses or sunglasses with graduated lenses, all the information and data listed in the medical prescription will have to be provided, and data processing by Galvani Srl will have to be accepted.
If the User sends any third party personal and sensitive data (purchasing a pair of glasses with graduated lenses for a third party) he/she aknowledges that he/she becomes the owner of the personal data processing action. As a consequence, he/she therefore takes on the obligations and responsibilities included in the Code of Privacy;
to this effect, the User guarantees to Galvani Srl that any third party data provided has been collected and processed in compliance with the Code of Privacy regulations and following third party express authorization (the third party data provided by the User will be considered by Galvani Srl as authorized and accepted by the third party); to this effect, the User gives Galvani Srl wide indemnity with regards to any dispute, claim or compensation request arising from a data processing damage that should reach Galvani Srl from any third party involved in any incorrect data provided by the User, breaching personal and sensitive data protection regulations.
The User has been informed, and he/she accepts that the execution of the contractual relationship involves personal data transmission, including sensitive data from entities outside Galvani Srl, which include external companies staff in charge of packaging and shipping (for UE Users), as well as external companies staff in charge of transportation, and esternal authorities administrative/tax staff, by virtue of primary or secondary national provisions and/or related administrative and fiscal provisions (for non UE Users).
By subscribing to the Newsletter, the User agrees to personal data processing and authorizes Galvani Srl to process data for marketing purposes and to send commercial/promotional material for profiling purposes.
We inform the User that personal data can include his/her image. We also inform the User that the images will be stored into third parties I.T. storages, properly identified by Galvani Srl.
The User aknowledges that Web data transmission cannot reach complete security levels.
Therefore, he/she is responsible for the accuracy of his/her personal data, and, possibly, correct them, update them or modify them during data processing. Galvani Srl can only be held responsible for the accurate and correct application of the security standards required by the law.

By contacting directly the data processing owner it is possible to know the name of the person responsible for the data processing and the authorized staff that work or cooperate with Galvani Srl.
Please note that anyone who sends his/her personal data can claim their rights enshrined by the Art.7 / Law 196/2003 at any time, as stated in the following text:
Art. 7
(Right to access personal data and other rights)
1. A data subject shall have the right to obtain confirmation as to whether or not personal data concerning him exist, regardless of their being already recorded, and communication of such data in intelligible form.
2. A data subject shall have the right to be informed:
a) of the source of the personal data;
b) of the purposes and methods of the processing;
c) of the logic applied to the processing, if the latter is carried out with the help of electronic means;
d) of the identification data concerning data processing owner, data processors and the representative designated as per Section 5(2);
e) of the entities or categories of entity to whom or which the personal data may be communicated and who or which may get to know said data in their capacity as designated representative(s) in the State’s territory, data processor(s) or person(s) in charge of the processing.
3. A data subject shall have the right to obtain:
a) updating, rectification or, where interested therein, integration of the data;
b) erasure, anonymization or blocking of data that have been processed unlawfully, including data whose retention is unnecessary for the purposes for which they have been collected or subsequently processed;
c) certification to the effect that the operations as per letters a) and b) have been notified, as also related to their contents, to the entities to whom or which the data were communicated or disseminated, unless this requirement proves impossible or involves a manifestly disproportionate effort compared with the right that is to be protected.
4. A data subject shall have the right to object, in whole or in part:
a) on legitimate grounds, to the processing of personal data concerning him/her, even though they are relevant to the purpose of the collection;
b) to the processing of personal data concerning him/her, where it is carried out for the purpose of sending advertising materials or direct selling or else for the performance of market or commercial communication surveys.
The rights referred to in the above mentioned Art. 7 / Law 196/2003, may be exercised by making a written request to

In particular, any subject, at any time, by sending an email to Galvani S.r.l., shall have the right to object, in whole or in part, the data processing carried out for: commercial information or sending of promotional material, direct sales or market investigation, commercial interactive communication.
For any request ex Art.7, par. 1 and 2, letters a), b), and c) of the Law 196/2003; Galvani S.r.l. can request a cost contribution fee from the subject, where the data belonging to the subject doesn’t exist or is not confirmed. The cost contribution fee cannot exceed the cost actually incurred, under the conditions and within the limits envisaged by the regulation, pursuant to Art.10 par. 8 of the Law 196/2003.
The User, with the electronic transmission of the confirmation of his purchase order, acknowledges the information and consents to the processing of personal data provided, in the manner and within the time frames specified under letters a) e b) of this Informative note.
With reference to eyeglasses with graduated lenses: the User, by providing the medical prescription and by confirming the order online, aknowlegdes the above mentioned Informative note and agrees to personal and sensitive data processing.
Galvani Srl is not responsible for received data that was not requested to the User, and in particular, for data that the User accidentally provides following an incorrect use of the functionality related to of the interpupillar distance measurement.
The User is informed that the data processing owner can modify and update the Privacy Policy, according to regulatory changes, which may occur.
According to Chapter IV. Art. no 25, c.6 “Transfer of personal data to third countries” of the Directive 95/46/CE, data can be transferred to countries outside the UE or outside the European Economic Area (which guarantee an adequate personal data protection). However, the data processing will be carried out according to and in compliance with this Informative note and the legal provisions.
